Leaks caused by a flat above are a grey area when it comes to compensation – unless you can prove the leaker was aware

QLast year I was contacted by the owner of the flat beneath mine advising that a leak from my bathroom had caused damage to their room below. I subsequently contributed £1,500 towards their repairs, despite not being able to locate the source of the leak.

I have since decided to replace my own bathroom, due to a build-up of mould. But upon having the works done it was discovered that the cause of the mould, and the original leak, was in fact the flat above mine.

I have contacted the owner, who has carried out repair works to fix the leak. Now my bathroom replacement is costing an additional £2,500, due to additional water damage, on top of the
